Three former chief justices on Florida’s Supreme Court say the state’s new death penalty law invalidates all previous death sentences.

In a court filing, Harry Lee Anstead, Rosemary Barkett, and Gerald Kogan all say that 390 death row inmates should have their sentences changed to life in prison without parole.

The U.S. Supreme Court has found Florida’s death penalty unconstitutional, and the legislature has just revised the law.

State Supreme Court hears arguments tomorrow.
