A Monroe County Circuity Court Judge today overturned Florida’s constitutional ban on same-sex marriage after a legal challenge by six gay couples, Judge Luis Garcia found the ban effectively makes those couples 2nd class citizens. The suit alleged the state’s ban violated the U.S. Constitution’s guarantee of equal protection under the law. Garcia’s order allowed the issuing of same sex marriage licenses in Monroe County as of next Tuesday.
