A new Florida law passed down from the Supreme Court says a jury has to be unanimous in recommending a death sentence. Because of that, the man who was convicted in the kidnapping, rape and murder of 11-year-old Carlie Brucia in 2004 does not face the death sentence. Joseph Smith will now likely face a new trial and prosecutors will try for the death penalty again.
