The developer of a proposed subdivision in Venice is petitioning the state for relief after the city council denied the planned development last month.
The attorney for the Michigan-based developer is filing under the Bert Harris Act, a state law meant to protect private property rights.
The developer is claiming the city’s denial was “unreasonable and unfair.” They claim that under the plan provisions put in place by the city, that no development can occur on the site near Fox Lea Farm at all.
