A man already on death row for a Manatee County murder was in front of a Sarasota County judge Monday…asking for his car and other belongings back.
One sticking point- Delmer Smith III will never leave prison alive…another is that some of those belongings are also evidence that police say link him to a 2009 Sarasota County murder.
Smith was charged in January with the murder of Georgeann Smith- that trial is expected to start in July.
A judge agreed to give back a number of possessions, including Smith’s car. No word on what exactly will become of the items.
