Thursday’s execution remains on schedule after the Florida Supreme Court stood firm against an appeal. Mark Asay is set to die Thursday for the murders of two men in Jacksonville in 1987. The white Asay shot Robert Lee Booker, who is black and Robert McDowell, who is of unknown race. The court misidentified McDowell’s race during the trial in 1991 and Asay’s lawyers say that was a problem and a violation of due process. The court ruled that his race was found out to be white or Hispanic and did not affect the trial.
